HR 3058 Making appropriations for the Departments of Transportation, Treasury, and Housing and Urban Development, the Judiciary, District of Columbia, and independent agencies for the fiscal year ending September 30, 2006, and for other purposes.

                                                                                         

BRIEF

  This year the Transportation and Treasury appropriation bill is expanded to fund Housing and Urban Development, the Judiciary, the District of Columbia the White House and numerous independent agencies. Out of the committee gate the bill arrived on the floor with two amendments intact: The requirement that federal agencies include disclaimers on video new releases to clarify that they were prepared at taxpayer expense from Rep. Rose Delauro (D-CT) and the prohibition on credit card companies from increasing annual percentage rate for any reason other than an action or omission of the card holder that is directly related to such account via Rep. David Obey (D-WI)

 

TRANSPORTATION

  Essential Air Services, a program that continues air service to communities that were served prior to the deregulation of the airline industry in 1978 would be funded at $104 million with $50 million from over-flight fees, fees paid by airplanes that did not take off from nor will land in the US.

   While the Federal Aviation Administration is funded at $8.2 billion, an FAA program, the airport and airways trust fund paid into by user fees is running a deficit. The House Committee urges the FAA to cut costs, limit new hires and reduce sick leave to ease spending. At the same time however the FAA is looking at losing 73 percent of its 15,000 air traffic controllers to retirement. Arguing that a one-to-one replacement is not prudent, the Committee seems to indicate that increased productivity, facilities consolidation and procedural changes may suffice. Raising the retirement age from 56 is also seen as an option for personnel shortages. A House amendment would increase safety spending at the FAA.

  Aviation safety gets nearly a billion after a $47 million increase and air traffic control facilities see an increase to $3 billion.

  On land, trucking safety would lose $40 million to spend $215 million via the National Highway Traffic Safety Administration and would use a 30 percent increase to $10 million for research into how traffic accidents can be avoided and their impact diminished. The 800,000 pieces of hazardous material transported around the US each day are protected with $26 million.

   With railroad safety funds around $3 billion the agency would look “to acquire, improve, or rehabilitate intermodal or rail equipment or facilities, including track, components of track, bridges, yards, buildings, or shops;  to refinance existing debt; or to develop and establish new intermodal or railroad facilities.” High Speed Rail funding took nearly a fifty percent cut from last year to spend $10 million as opposed to $19 million in 2005. AMTRAK would be funded at $1.2 billion to maintain services to about 80 percent of its passengers. The Committee rejected the President’s request to cut $190 million and leave infrequently used routes to fail and close. The funding does not provide for 18 routes where the per passenger subsidy level exceeds $30.00. The carrier gets $550 million in grants this year and $50 million to repair the Northeast corridor lines. Since floor action on this bill in the House the administration has begun paring down AMTRAK funding and is considering privatizing some AMTRAK responsibilities.

   By water the St Lawrence Seaway operations will spend about $16 million to maintain the US’s part of the project. Maritime security would receive $156 million or $58 million over 2005. The National Defense Tank Vessel Construction Program that spent $74 million last year to build five privately owned vessels is ended.

 

   TREASURY

  Terrorism and financial intelligence would get $35 million. $67 million to build a new headquarters would be reduced and the funds would be added to the program that investigates lead paint contamination in low income housing.

  The fund for payments to air carriers impacted by terrorism is increased.

The Bureau of Engraving and Printing, funded largely by currency and stamps sales would run a $28 million deficit this year and as the public debt increases so does the cost of managing it; $177 million this year as opposed to $173 last year for the Bureau of Public Debt

  The IRS gets over $10 billion. To cut corners and provide more funds for tax enforcement the IRS has closed several taxpayer assistance centers without, the committee laments, any consultation or concern for impact to taxpayer compliance. A House amendment would add $38 million to enforcement efforts. Another House Amendment would cut $24 million from the IRS budget and spend it for community development grants. The IRS oversight board proposed cut of fifty percent was nullified. Enforcement functions would spend $4.5 billion or $75 million over last year. Training IRS agents in taxpayer rights, dealing courteously with taxpayers, and cross-cultural relations is continued.

  Treasury is allowed “to purchase uniforms, insurance, and motor vehicles without regard to the general purchase price limitation”. Redesigning the one dollar bill is again prohibited.

 

HUD

  Tenant rental assistance $15.8 billion and an amendment that added $100 million. $142 million to revitalize severely distressed public housing was eliminated due to the conclusion that too many projects funded years back have not even been begun but House amendment activities restored $60 million to the program. Native American Housing block grants took a $21 million cut to spend $600 million. The block grant program for Native Hawaiians began last year and continues with $8 million in funding. Guarantees for Indian housing loans were cut severely from $5 million last year to $2.5 million in 2006. Housing help for persons with AIDS settled at $268 million. Rural housing and economic development dropped from $23 million last year to $10 million this year.

  Community development funds were cut $500 million to spend $4 billion. $6 million for community loan guarantees is completely eliminated.

   Last year’s level of $23 million to revitalize brownfield sites is reduced to zero.    

  Habitat for Humanity gets $30 million.

  Homeless assistance gets $1.4 billion.

   A new program would spend $13 million to develop construction and safety standards for manufactured homes and a program that tests low income housing for lead contamination would be cut by $47 million to spend $119 million.

 

WHITE HOUSE

President gets $450,000. White House salaries get $53 million, down from $61 million last year. Special assistant to the President $4.5 million. The President’s residence $12 million. White House repair and restoration $1.4 million. National Security Council $8 million. National Drug control $26 million. Counter drug technology $30 million. ($10 million cut).  High intensity drug trafficking areas $227 million. Other drug control $223 million. A House Amendment added $25 million to fight drugs taking the money from the General Services Administration budget.

   Unanticipated needs can spend $1 million.

 

SOME AMENDMENTS

An amendment to cut Supreme Court salaries by $1.5 million and relating the cut to the eminent domain issue of New London CT failed, but another would prohibit Funds from being used to enforce that Supreme Court decision. Two amendments in the House to reduce restrictions on family and academic travel to Cuba and a third that would have prohibited an economic embargo of Cuba failed. A similar amendment in the Senate also failed. The IRS would get and extra $38 million for tax enforcement but a shift of $24 million from the IRS to the Community Development fund also succeeded. No funds can be used for contract deals with corporations having an off-shore (tax-haven) address. The House provided no funds to enforce any agreement between China and UNOCAL's potential oil company sale. (Note: that potential sale was rejected)

   A Senate amendment to raise the minimum wage failed and another to give up cost of living pay increase passed. The Senate also agreed to end an independent counsel investigation into former HUD Secretary (1993 to 1997) Henry Cisneros and to return to $2500.00 the limit on government credit cards for immediate purchases. The limit was raised from $2,500 to $250,000 and the increase became obvious in the aftermath of Hurricane Katrina.

FULL COMMITTEE REPORTS FY06 TRANSPORTATION, TREASURY, HOUSING AND URBAN DEVELOPMENT BILL

Amendments adopted in Full Committee:

(Hoyer):  provides pay parity between civilian and military personnel

(Delauro):  Requires federal agencies to include disclaimers on video new releases to clarify that they were prepared at taxpayer expense. 

(Obey):  Prohibits a credit card company from increasing annual percentage rate for any reason other than an action or omission of the card holder that is directly related to such account. 

FY05 Comparable:  $63.172 billion ($18.418 billion Mandatory)

FY06 Request:  $60.705 billion (assumes transfer of economic development programs to Commerce Department)

FY06 Chairman’s Mark:  $66.935 billion ($18.993 billion Mandatory)

The bill represents a 6% growth over last year’s comparable levels.  The bulk of this increase goes to providing guaranteed levels of discretionary spending for various Highway, Transit and Aviation programs.  If the bill did not provide these mandated levels, the rules of the House of Representatives would prevent consideration of the bill.  This preferential treatment is unique to certain transportation programs and is not afforded to any other discretionary program including Veteran’s Medical Care, Homeland Security funding or National Defense programs. 

 

Boosts Highway Spending:

Federal-aid highways spending is $37 billion, as set by HR 3.  This is an increase of $1.6 billion over the President’s request and $1.9 billion over the FY 2005 enacted level, excluding emergency supplementals.

 

Supports Aviation:

A total of $14.427 billion is provided to the Federal Aviation Administration (FAA) -- $877 million above the fiscal year 2005 level and $1.741 billion above the President’s request.  This includes $8.2 billion in FAA operations, $3.6 billion for the Airport Improvement Program and $104 million for Essential Air Service.  The bill includes $25 million to hire and train 595 new air traffic controllers, and an additional $8 million above the request to hire and train of safety inspectors in the office of aircraft certification and flight standards.  The bill also extends the current provisions of war risk insurance, including current premium price caps, for one additional year. 

Addressing Critical Housing Needs: 

The Department of Housing and Urban Development (HUD) is funded at $37.5 billion, $$1.547 billion above last year's level and $4.32 billion above the President's Request.

 

Funding for Section 8 programs is split into two accounts to provide better accountability and oversight.

 Capital Investments in Transit

Transit program spending totals $8.482 billion as mandated by HR 3, $836 million above FY05 and $701 above the request. 

 

Supports National Anti-Drug Efforts

Provides $497 million to the Office of National Drug Control Policy, including:

Provides for Smarter, More Efficient Amtrak Operations

The bill provides $550 million for Amtrak, $190 million over the President’s budget request and $657 million below FY05.  The bill also prohibits taxpayer funding of Amtrak’s most unprofitable routes.

Federal Judiciary:  Provides a 6% increase in funding for Federal Judiciary.  Total funding is $5.8 billion, $341 million above FY05 and $185 million below the request.  This level will fully fund the court’s revised request for security improvements at Federal judicial facilities, and enable the courts to effectively process priority criminal, civil and bankruptcy cases. 

 

Agency Funding

Department of Treasury is funded at $11.6 billion, $336 million above FY05 and $94 million below the President’s request. 

The Internal Revenue Service is funded at $10.5 billion, $313 million above FY05 and $130 million below the request.  The bulk of the increase is for the tax enforcement activities of the IRS.

Federal Election Commission is funded at the budget request of $55 million, $3 million above FY05 and the Election Assistance Commission is funded at $16 million. 

National Historical Publications and Records Commission is funded at $7.5million ($5.5 million for grants and $2 million for administrative costs), $7.5 million above the President’s request.
