HR 2863 making appropriations for the Department of Defense and for other purposes.

                                                                                         

                                                                                         

BRIEF

   The taxpayer’s largest spending ticket, the Department of Defense (DOD) Authorization sets the basis for programs, procurement and spending amount limits under the DOD.

  The money will be spent by all of the Armed Services other than the US Coast Guard to procure aircraft, missiles, weapons and tracked combat vehicles, ammunition, and shipbuilding and conversion. Weaponry funds would also be used for research, development, test, and evaluation.

   Everything from special air filters for combat vehicles to naval ships and troop transport planes are covered under procurement. Matters ranging from spouse’s education and child support payments, legal matters regarding abuse, murder and child abuse are included along with generous offers of benefits to increase recruitment.

   The most broadcast matter of women in combat comes from a provision established in 1994 and now codified in the bill to prohibit female soldiers from being assigned to duty that is directly involved “with a direct ground combat unit; performance of long-range reconnaissance and Special Operations missions; prohibitive costs of berthing and privacy arrangements; or, job-related physical requirements that exclude the vast majority of female members.”

   The DOD requested an increase in end force for the current average of 1.4 million troops defense-wide. The Committee recommended raising the level by 30,000 for the army and 4,000 for the Marines to bring the end strength to 512,400 for the Army and 179,000 for the Marine Corp, but finding willing enlistees has become a problem according to DOD sources and news stories. Attracting enlistees would be enhanced by a proposed 3.1 percent across-the-board pay hike, raising the active duty reenlistment bonus from $60,000 to $90,000 and increasing the cutoff point in a soldier’s career after which reenlisting would not pay a bonus from 16 years to twenty years. Numerous other provisions improving access to education for military spouses, pay and housing differentials for overseas living, health care benefit improvements and a variety of support services for families of troops on active duty also are offered.

  Of interest to perennial Marines the Corp will be absorbed into the Navy as a full partner, The Department will be renamed the Department of Navy and Marine Corp and the Secretary would be the Secretary of Navy and Marine Corp.

   Nuclear weaponry, energy and cleanup are covered by several provisions in the bill and the responsibility for research and development, environmental clean up and disposal of nuclear waste and weapons falls on the Department of Energy along with DOD. Efforts continue to deal with leftover nuclear weapons and waste from the former Soviet Union and nuclear waste in the US has reached a level requiring the creation of an above ground interim disposal site to be used for storing waste from commercial reactors until Yucca Mountain in Nevada is ready to receive the Nation’s nuclear waste.

   Nuclear weaponry along with weapon procurement in general will continue to be a priority matter. The administration’s request for funds to continue research into DOD’s coveted Robust Nuclear Earth Penetrator project were eliminated ($4 million) but $ 7 million has been provided to carry out a study measuring the feasibility of alternative “Penetrator” opportunities.

   $49 billion is included for the on-going operations in Iraq and Afghanistan in anticipation of another supplemental request from the President expected in a few months. (The recently approved $82 billion was for 2005 defense spending and other matters)

     A unique section puts forth some specific rules on how soldier behave. Rules are created establishing no statute of limitations for the prosecution of murder and rape and the period of time in which child abuse and stalking prosecutions can go forward is extended.

   In this bill some elements give themselves readily to the direction the Secretary of Defense has promised to take the Armed Forces, to that of a more flexible, self-sufficient, streamlined and quickly deployed organization to handle mostly small scale operations such as in Iraq and Afghanistan. Procurement move towards in-the-field immediacy for handling everything from repairs to amputations. Transport of materiel quickly finds support in Air Force and Navy transportation procurement requests. DOD laboratories are to be revitalized and research is increased, operational files of the DOD are now exempt from public disclosure, a defense education program would emphasize study of math and science relating to DOD needs and extra efforts are being made to vitalize foreign language training programs.

AMENDMENTS

    Amendments that would prohibit funds from the bill to be spent on military action in Uzbekistan and prohibiting the President from taking military action against Syria, Iran or North Korea without authorization from Congress failed in the House but succeeded in the Senate. Another amendment that would put forth the view “coercive and abusive religious proselytizing at the Air Force Academy is inconsistent with the professionalism and standards required by those who serve at the Academy” failed. Yet another amendment, however, that would require a report on religious freedom and tolerances at the Air Force Academy passed by voice vote. The Senate heavily amended the bill with the most noted from Senator John McCain (R-AZ) who succeeded in passing an amendment to clarify the US policy on how prisoners are treated. Another amendment restored funds for the Community Development Block Grant Program that was funded in a continuing resolution last week in a fashion that allowed the House to cut funding to those programs in some states by 50 to 75 percent. A non-germane amendment agreed to by voice vote would provide for appropriations to meet the need of low income energy needs this Winter.

 The House Committee explained its’ work this way:

“This legislation would address several general and outcome-related performance goals and objectives. The general goal and objective of this legislation is to improve the quality of life for military personnel and their families, military readiness, the modernization and eventual transformation of the armed forces, to enhance the development of ballistic missile defenses, and to improve the condition of military housing and facilities.

“With respect to the outcome-related goal of improving the quality of life for military personnel and their families, the objective of this legislation is to:

(1) Provide a 3.1 percent across-the-board pay raise for our men and women in uniform. The raise would reduce the gap between average military and private sector pay from 5.1 percent to 4.6 percent; and

(2) Eliminate the provision to pay reservists a reduced housing allowance when mobilized to serve on active duty for greater than 30 days and less than 140 days. It also clarifies that full basic housing allowance would be paid to Reservists who are mobilized for less than 30 days in connection with a contingency operation; and

(3) Address manpower needs with an increase of 10,000 personnel in the Army and 1,000 in the Marine Corps in 2006. That would bring the Army end strength to 512,400 and the Marine Corps to 179,000. In addition, the committee would provide the Secretary of Defense with the authority to continue to grow the Army to 532,400 and the Marine Corps to 184,000 during the 2007 through 2009 period.

“With respect to the outcome-related goal of improving force protection for our troops, the objective of this legislation is to:

(1) Provide several billion dollars in funding for force protection initiatives, including armor for vehicles, new munitions and improvised explosive device jammers; and

“With respect to the outcome-related goal of successfully prosecuting continuing operations in Iraq and Afghanistan, the objective of this legislation is to:

(1) Provide an additional $49.1 billion in contingency operations supplemental funding to be appropriated for fiscal year 2006 to support the war on terrorism's operational costs, personnel expenses and the procurement of new equipment; and

“With respect to the outcome-related goal of improving military housing and facilities, the objective of this legislation is to:

(1) Provide $12.1 billion for military construction and military family housing programs; and

(2) Allow the secretaries of the military departments to exchange surplus property for construction projects, land, or housing.”

The Senate explained its work on the bill this way:

The Committee recommendation of $440,216,117,000 includes $390,216,117,000 in non-contingency spending to develop, maintain, and equip the military forces of the United States and $50,000,000,000 in spending for contingency operations related to the Global War on Terror. The funding for contingency operations is made available pursuant to section 402 of H. Con. Res. 95 (109th Congress), the concurrent resolution on the budget for fiscal year 2006.

The fiscal year 2006 budget request for activities funded in the Department of Defense Appropriations bill totals $397,214,410,000 in new budget authority. The request includes $244,600,000 in mandatory spending.

In fiscal year 2005, the Congress appropriated $494,000,570,000 for activities funded in this bill. This amount includes $391,155,312,000 in non-emergency appropriations and $102,845,258,000 in emergency supplemental appropriations.

Excluding supplemental appropriations, the Committee recommendation in this bill is $937,195,000 below the amount provided in fiscal year 2005 and $6,998,293,000 below the amount requested for fiscal year 2006.

Troop Support: Fully funds the 3.1% military pay raise and end strength requirements proposed in the President's budget; an increase of $20 million is provided for the military’s Family Advocacy program to fight domestic violence; restores Impact Aid to $30 million, which was terminated in the budget request.

Bridge Fund:  The bill includes $45.3 billion in emergency funding for military operations in Iraq and Afghanistan, available on October 1, 2005.  The fund is designed to cover 6 months worth of contingency operations costs in the global war on terrorism.  The majority of this funding – $36.7 billion, or 80% – is provided for military pay and operation and maintenance accounts.  Funds are also provided for the following:

Army Ground Systems:  The Army’s Future Combat System (FCS) research and development program is funded at $3.0 billion, about $400 million below the request due to significant development and contracting delays.  The Non-Line of Sight Cannon (NLOS) program would receive an increase of $50 million.  The Stryker vehicle program is fully funded at the requested level of $878 million for 240 vehicles.

 

Navy Shipbuilding:  The President’s request included funding for 4 ships: one Virginia-class submarine, one LPD-17 amphibious ship, one Littoral Combat ship (LCS), and one T-AKE cargo ship. The recommendations fully fund these and add 4 additional ships:  one DDG-51 class destroyer ($1.4 billion); two LCS ships (an increase of  $440 million); and one additional T-AKE ($380 million).  Included is a recommendation to cut the Navy’s DD(X) destroyer program by a total of about $1 billion - the combination of a reduction of $0.7 billion for advance procurement and $0.3 billion out of R&D; $670 million would remain in R&D.  The recommendation is consistent with the levels approved by the House for the DD(X) program in the National Defense Authorization Act for Fiscal Year 2006.

 

Navy/Marine Corps Aviation:  The bill fully funds the request for 130 aircraft, including 42 F/A-18’s, compared to 115 total aircraft provided in fiscal year 2005.  The bill fully funds the V-22 aircraft procurement program ($1.5 billion for 11 aircraft).  The VXX Presidential helicopter replacement program is fully funded, as requested ($0.9 billion).

 

Air Force programs:  The bill would include purchasing 25 F/A-22 aircraft, as requested, and provides $3.2 billion.  The C-17 program is fully funded (15 aircraft at $3.5 billion).  The bill restores funding for the C-130J multiyear procurement program by transferring funding from the Navy to the Air Force; the Air Force will procure 9 aircraft while the Navy will procure 4 tanker variants. The Joint Strike Fighter (a joint program with the Navy) is funded at almost $5 billion in R&D, as requested, but a reduction of $152 million for advance procurement is made due to development delays and since the first production aircraft will not actually be purchased until FY08.  Finally, roughly $120 million is reduced from the request for Global Hawk funding due to an anticipated slowdown in the production schedule.

 

Missile Defense:  The bill provides a total of $7.63 billion for ballistic missile defense, a decrease of $143 million from the budget request.  The recommendation does, however, include additional funding for an Asymmetric Warfare Initiative and S-Band radar.  The Kinetic Energy Intercept program is funded at the President’s requested level of $225 million.

 

Space Programs:  Funds most of the Administration’s request for major space programs.  However, the bill makes reductions to the request for two programs; Space radar (-$126 million) and transformational communications satellite (-$400 million).  Remaining funds for these programs are for research and development activities, and for activities to reduce the costs for potential future procurements.

 

TerminationsThe bill terminates funding for the Joint Air to Surface Standoff Missile (JASSM).  The President requested $150 million for the program.  The bill provides $2 million to close out existing contracts.   The missile has repeatedly failed reliability and performance tests.  

Drug Interdiction and Counter-drug Activities:  The bill provides $907 million for DOD’s counter-drug activities and to fight narcoterrorism, $11 million over the request and roughly last year’s level.

         All funds within the $25 billion are provided through specific appropriations accounts, and will be available upon enactment of the bill.  Quarterly reports are required on the obligation of funds. 

 

 

Manpower

 

o        Title IX provides $1.3 billion for the additional manpower costs stemming from Operations Iraqi Freedom and Enduring Freedom.  Funds are also made available to support additional military endstregth levels, should these be provided for, and enacted into law, in the conference agreement on the National Defense Authorization Act for Fiscal Year 2005.

o        Title IX provides a total of $126.1 million to continue supporting increased amounts for military personnel in Family Separation Allowance (FSA) from $100 to $250 per month, and in Imminent Danger Pay (IDP) from $150 to $225 per month.

o        Title IX provides $683 million for the Defense Health Program.  These funds will cover additional costs incurred by the military medical system, including the Ready Reserve members and their families.

Oversight

 

o        The Conferees direct the Secretary of Defense to submit a report within 60 days of enactment of this legislation on the allocation of these funds, with quarterly reports submitted thereafter. These quarterly reports shall include detailed accounting of obligations and expenditures of appropriations provided in this Title for the continuation of the war in Iraq and Afghanistan; and a listing of equipment procured using funds provided in this Title.

o        The Conferees direct classified and unclassified reviews regarding U.S. financial assistance to the Iraqi National Congress (INC) and alleged intelligence compromises involving the INC.
