S.1699 A bill to amend title 18, United States Code, to provide criminal penalties for trafficking in counterfeit marks.

BRIEF

Counterfeit products and services are often made to look legitimate by the use or application of a counterfeit ‘mark’. This bill would impose penalties on anyone trafficking in just the mark rather than the counterfeit product.

The bill would order the court to destroy any articles bearing the mark and would require the person convicted to pay restitution to the ‘mark’ owner and any other victim.

Sponsor: Senator Arlen Specter (R-PA)
