H.R.916 To provide for loan repayment for prosecutors and public defenders.

 

The 1968 Omnibus Crime Control and Safe Streets Act is amended to allow the Attorney General to take on the obligation to repay student loans for those borrowers who agree to remain employed for at least three years as a state or local criminal prosecutor or state, local or Federal criminal public defender. The program is on a first come, first served basis and hopes to induce qualified individuals to enter and continue employment as prosecutors and pubic defenders.

 

After three years another loan repayment agreement may be reached requiring the employee stay on for a time less than three years. The amount absorbed per employee by the Attorney General can not exceed $10,000 per year or $60,000 total.

 

If the employee is involuntarily separated from employment for misconduct or voluntarily separates from the job before the agreement period ends, any amounts paid on the loan must be repaid to the Attorney General. If the employee fails to repay the amount the money can be sought by any methods available under law the Federal government uses to make such collections but may be waived if the Attorney General is shown that recovering the funds would not be equitable or in good conscience or against the pubic interest.

Cost to the taxpayers: “There are authorized to be appropriated to carry out this section $25,000,000 for fiscal year 2008 and such sums as may be necessary for each succeeding fiscal year.”
