H.R.2637 To amend the Fair Labor Standards Act, with respect to civil penalties for child labor violations.
Current law is amended to increase civil penalties for violations of child labor provisions and prohibitions including minimum wage and allowed maximum hours allowed.
Violating the law would bring a fine of $11,000 for each child or $50,000 if serious injury is involved. Serious injury is defined as permanent: loss or substantial impairment of one of the senses (sight, hearing, taste, smell, tactile sensation); loss or substantial impairment of the function of a bodily member, organ, or mental faculty, including the loss of all or part of an arm, leg, foot, hand or other body part; or paralysis or substantial impairment that causes loss of movement or mobility of an arm, leg, foot, hand or other body part.
The court would weight the size of the business and the circumstances surrounding the violation to determine the amount of the fine
