S.RES.50 An original resolution amending Senate Resolution 400 (94th Congress) to make amendments arising from the enactment of the Intelligence Reform and Terrorism Prevention Act of 2004 and to make other amendments.
Senate Resolution 400 passed by the 94th Congress (1976) established the jurisdiction of the Senate Select Committee on Intelligence has over the various intelligence organizations of the US Government. (PL 108-458) the authority granted the Committee includes authorizing funds.
Despite changes in the intelligence community over the past two years to include the creation of and filing of the position of Director of National Intelligence the jurisdiction of the committee under the 109th Congress remained unchanged leaving the DNI position technically without oversight.
In 2004 the DNI replaced the Director of Central Intelligence as head of the US intelligence community and the DNI is included in all other relevant sections of the S RES 400 text. Referrals to certain committees are also revised.
The resolution under revision also provides for the Committee to address ethical matters as they relate to handling classified materials by Committee staff in the areas of clearances and unauthorized disclosure of classified materials.
