S.4042 A bill to amend title 18, United States Code, to prohibit disruptions of funerals of members or former members of the Armed Forces.
Following incidents in 2006 when an extreme religious right group began heckling attendees at funerals of US military personnel this bill takes aim at those who would disturb the mourners.
It is unlawful for anyone to engage in a disrupting activity 60 minutes before or after a funeral of a member or former member of the Armed Forces if the ceremony is at a cemetery not under control or part of the Arlington National Cemetery.
The activity is prohibited within 150 feet of the intersection between the property line of the cemetery or mortuary, home or house of worship or any other location and a road, pathway or other route to ingress to or egress from the funeral location.
Disrupting activities include any willful making or assisting in making noise or diversion that is not part of the funeral and that disturbs or tends to disturb the peace or good order of the funeral with the intent to do so. Also prohibited is the willful and unauthorized impeding of the access or egress from the funeral location.
Violators will be fined and imprisoned for up to one year or both.
